Indoor/Outdoor/Outdoor Plus Boarding & Care Agreement

For: 

The Ranch, 2401 Burnhamthorpe Road West, Oakville, L6M 4H1, and

Capstone Farm, 5556 Bell School Line, Burlington L7M 0P1

This Equine Boarding Agreement is made on 

between

and THE OWNER of the Horse(s).

FEES:

In consideration of $420.00 (outdoor board) or $600.00 (outdoor plus board) or $700.00 (indoor board) per horse per month (HST included) paid by the Owner in advance on the first day of each month, the Stable agrees to board said Horse. Board is inclusive of:

  • Full-time or day-time, group turn-out in all weather conditions
  • Use of all facilities
  • One (1) tack storage area (combination provided)
  • Ad libitum hay and water
  • Grain; owner fed for outdoor board; fed once daily with suppliments and blanket service by barn staff for outdoor plus board; or two customized grain rations with suppliments per day for indoor board (suppliments provided at Owner's expense).
  • Indoor board also includes a bedded stall and blanketing and/or boots as required/if needed (Owner to provide & clean/repair blankets)

**Any additional feed required such as supplements or vitamins, are to be provided at the Owner's expense.

NSF or other returned cheques will result in a $50.00 charge per occurrence.

Lay-up care (prescribed stall-rest), if/when required, will be the responsibility of the Stable unless otherwise arranged i.e. the stable will administer medication, wound-care, poultice, hand-walking etc. as prescribed by a veterinarian.  The fee for lay-up care is $20.00 per day in addition to monthly board.

The fee for feeding/dosing of medication, wound care or any other care that does not require stall-rest is $5.00 per handling PLUS supplies as required (ie. wound dressing or poultice material).

TURN OUT:

The Owner shall be expressly responsible for all exercise and it is understood that the Horse will be turned out either full time (outdoor board) or day-time (indoor board) with other horses and in all weather conditions. The Owner understands that the Stable cannot be held responsible for any accidents or injuries caused to the horse(s) when turned out with other horses or individually in a paddock.

STANDARD OF CARE:

The Stable agrees to provide normal and reasonable care to maintain the health and well-being of said horse(s).

Veterinarian vaccinations, deworming and dentistry are to be arranged by the Owner, and dates and times are to be communicated to the Stable. The Owner is obligated to pay the expenses of these and all other Veterinary services, including a reasonable stable charge.

Regular Farrier attention is to be arranged by and paid for by the Owner

EMERGENCY CARE:

If medical treatment is needed, the Stable will attempt to contact the Owner, but in the event the Owner is not reached, the Stable has the authority to secure emergency veterinary and/or blacksmith care. The Owner is responsible to pay all costs relating to this care. The Stable is authorized as the Owner's agent to arrange billing to the Owner.

RULES AND REGULATIONS:

The Owner agrees to abide by and confirm to all rules and regulations as determined and posted from time to time by the Stable. The Owner accepts full responsibility for the safety of his/her visitors and/or riders they may bring onto the stable premises, and shall ensure that all visitors abide by such rules and regulations. All riders under the age of 18 years, visiting or otherwise, must wear correct and proper headgear and footwear.

The Owner will ensure all visitors arranged by the Owner to ride the Owner's horse at any time will have first executed the Stable's Agreement for Release and Waiver prior to riding.

No outside coaching is permitted unless arranged as a clinic with permission of the Owner. No part-boarding is permitted at The Ranch.

RISK OF LOSS:

While the horse is boarded a the Stable, the Stable shall not be liable for any sickness, disease, theft, death or injury suffered by the horse(s) or any other cause of action arising from or connecting to the boarding of this (these) horse(s). All risks are assumed by the Owner. All costs, no matter how catastrophic, connected with boarding are borne by the Owner.

The horse(s) and all tack and equipment of the Owner and lodged on the Stable premises shall be at the sole risk of the Owner, who assumes all responsibility for the insuring of the horse(s), tack and equipment owned by him/her, while on the Stable premises.

INDEMNITY:

The Owner agrees to carry personal liability insurance coverage on said horse(s) through Ontario Equestrian or other insurance.

HORSE HEALTH PRIOR TO DELIVERY:

On arrival to the premises of the Stable, the Owner's horse(s) shall be free from infectious, contagious or transmissible disease. The Owner must attest to the horse(s) health and current immunization status. The Stable has the right to quarantine the horse for up to two weeks at the owners expense and at indoor board rates or to refuse the horse(s) within seven (7) days of date of arrival if not in proper health.

TERMINATION:

Either party may terminate this agreement.

NOTICE: 

The Owner agrees to give the Stable one (1) months written notice of departure of the horse(s). Any and all outstanding charges must be paid in full by the Owner before the horse(s) my leave the Stable. The Owner cannot assign this agreement unless the Stable agrees in writing.

The Stable reserves the right to notify the owner within seven (7) days of the horse(s) arrival if the horse(s), in the Stable's opinion, is (are) deemed dangerous or undesirable for a boarding facility, and in such a case, the Owner is responsible for removing the horse(s) within seven (7) days and for all fees incurred during the horse(s) stay at the Stable. After all fees have been paid, the Agreement is concluded.

RIGHT OF LEIN:

The Stable has the right of lien as set forth in the law of the Province of Ontario for the amount due for board and additional agreed upon services, and shall have the right, without process of law, to retain said horse(s) until the indebtedness is satisfactorily paid in full.

  • I request permission to participate in horseback riding and other activities at The Ranch. I fully understand that horseback riding, handling and grooming of horses and other stable activities are very dangerous.
  • I wish to participate in these activities knowing that they are dangerous.
  • I accept and assume all the risks of injury (including death) to me or my property.
